A. Terms and Conditions

1. Coverage

1. These Terms and Conditions (T&C) by Nejcraft Retail s.r.o., V Hájku 196/17, 31200 Plzeň, Czech Republic, ID: 23826126, VAT: CZ23826126 (hereinafter: Nejcraft Retail or provider) apply to all contracts concluded through our website https://store.nejcraft.cz.
2. Customers in terms of these conditions are both consumers and contractors.
3. Entrepreneur is every natural person or legal entity that acts in exercise of its trade, business or profession, when entering into this agreement.
4. A consumer is every natural person who enters into a legal transaction for a purpose that cannot be attributed to its commercial or self-employed professional activity.
5. The inclusion of the consumer's own terms is revoked insofar as not agreed otherwise.

2. Contractual Object, License for Use

1. The object of the contract is the sale of goods or downloads of software products (digital contents). The details, especially the significant characteristics of the respective software, are obtained from the article description and the supplementary details provided on Nejcraft Retail’s website.
2. The offered software is copyright protected. The customer receives a simple license for use with every purchased software product, insofar as not stated differently in the respective article description on our website.

3. Registration and User Account

1. To acquire software from Nejcraft Retail, the customer may create a user account by registering with an e-mail address and personal password. The registration is free. To activate the account, the customer must confirm via link in the registration e-mail.
2. The customer is responsible for ensuring that no third party can access their account and must keep credentials confidential. Upon suspicion of unauthorized access, they must change their password immediately.
3. If personal data changes, the customer must update it under “My Account.” Account transfers to third parties are not allowed.
4. By registering, the user agrees to receive product updates and offers by e-mail. Consent can be revoked anytime in writing.

4. Conclusion of Agreement (Postal Delivery)

1. Product descriptions on the website are non-binding and do not constitute offers.
2. The customer can place an order online using the “cart” and “buy now” button. An automated e-mail confirmation follows, which does not yet form a contract.
3. The contract is concluded within twenty-one (21) days when Nejcraft Retail confirms the order or dispatch.

5. Conclusion of Agreement (Download Products)

1. Product descriptions on the website are non-binding and do not constitute offers.
2. The customer places a binding offer using the “cart” and “buy now” button. An automated confirmation e-mail follows.
3. The contract is concluded within one (1) day by written confirmation including digital delivery.
4. The customer must ensure that the provided e-mail address is valid and not blocked by spam filters.

6. Prices, Payment, and Shipping

1. Prices shown include VAT and all applicable fees. Offers may be limited by time or quantity.
2. Payment is due upon receipt of the order confirmation and can be made by credit card, PayPal, or Amazon Payments.
3. Payments are processed by external providers. Depending on the provider, a user account may be required.
4. For downloads, no additional fees apply beyond normal internet costs. Shipping fees for physical goods are displayed before purchase.

7. Reservation of Title

1. Delivered goods remain the property of Nejcraft Retail until full payment.
2. Before ownership transfer, pledging, mortgaging, or modification without consent is not permitted.

8. Warranty

1. Statutory warranty provisions apply.
2. For entrepreneurs: limitation is 1 year for new goods, 6 months for used goods.
3. For consumers: limitation is 2 years for new goods, 1 year for used goods.
4. Exceptions apply for injury, health, essential obligations, intent, or gross negligence. Liability under Czech Product Liability Act remains unaffected.

9. Liability

1. Compensation follows statutory provisions.
2. Nejcraft Retail is fully liable for intent or gross negligence, and for foreseeable damages under essential obligations.
3. Nejcraft Retail is not liable for slight negligence outside essential obligations.
4. Exclusions do not apply to injury, life, or health. Czech Product Liability Act remains unaffected.

10. Others, Jurisdiction

1. Czech law applies, excluding UN Sales Law. For EU customers, mandatory consumer protection laws of their residence may apply.
2. Jurisdiction is the registered office of Nejcraft Retail, or the customer’s location at Nejcraft Retail’s choice.
3. If a provision is invalid, the remainder stays valid under statutory replacement.
4. Contract language: English.

2. Technical Steps for Contract Conclusion

Outlined for both postal and digital delivery in sections A.4 and A.5 above.

3. Storage of Contract Text

The contract text is stored internally and not accessible to the customer. Order info is sent via e-mail.

4. Correction of Input Errors

Before submitting the order, customers can review and correct entries on the order overview page.

5. Available Contract Languages

Only English is available for contract conclusion.

C. Revocation Instruction for the Consumer

1. Right of Revocation

Customers may revoke within 14 days without reason. The period starts upon receipt of goods or digital delivery. Revocation must be sent to Nejcraft Retail s.r.o., V Hájku 196/17, 31200 Plzeň, Czech Republic, E-mail: support@nejcraft.cz.

Consequences: Nejcraft Retail refunds all payments including standard shipping costs within 14 days of revocation notice, using the same payment method.

2. Exclusion of Revocation

The right of revocation does not apply to sealed software or media unsealed after delivery.

3. Expiration of Revocation (Downloads)

The right expires when execution begins after explicit customer consent and acknowledgment of loss of revocation right.

4. General Return Information

Return goods in original packaging if possible, undamaged, and well protected. This is not mandatory but recommended.
